Here to Help

Where do I start?

If you have come to our page then you are probably looking to purchase a Marchantos OOAK bear.  This can be a stressful time and process so we try to make it as easy as possible.  Firstly you can email us for advice before ordering, or you can pop over to our Facebook page to get ideas. We are always happy to help.

I have decided Id like to buy a bear, what do I do next

You can either place your order via the website or send us a message over on Facebook.  We will discuss with you requirements and any special items, embroidery or design you may like. When this is agreed and you are happy we will ask for a 10% deposit and when that is received we will send you an order number and expected making up date. Please note we sometimes have a waiting list so if you need your bear urgently please let us know so we an try our very best to find a slot. We will then send our postal address so you can post your items (tracked please for safety) and that is it! Please make sure you put your name and order number in your package so we know who its for.

Deposits

All we ask is that you provide a 10% holding deposit for your order which will be taken off your final invoice. We ask for this to secure your place in our order book. If you change your mind we will refund your deposit. This payment can be made via Paypal or bank

Your bears are very expensive

We have been making bears for a long time and pride ourselves on our reviews, repeat customers and customer service. We have never "just knocked bears out", our bears are all one-offs and made to the the highest standards. We will have spent an exceptional amount of time on each bear so it will be the bear you ask for. Each bear (memory) takes a minimum of 8 hours and from start to finish your items will be treated with the upmost respect. We have attached a description of the time put in to each bear

What happens next

As soon as your parcel arrives at our address, we will let you know and then go over any final design details with you before making your bear. If you need to make changes to your design please try and do so before we start work as once fabric is cut it is cut and any changes to embroidery etc will incur an extra charge.

The final chapter!

Once your bear is completed, we will let you know, and send you an invoice for remaining funds due and postage. Your bear will be wrapped and posted tracked mail (please always make sure we have the correct address and if you are away or on holiday please advise)).  We will email you with a tracking number on the day of despatch.  If you'd like photographs of your finished items please let us know before we parcel up.

The small print

Here at Marchantos we will try our very best to give you a 101% service.  If you feel we have failed you in any way please let us know so we can rectify the situation.  Please remember that although insured, and postage insured we cannot insure against cherished clothing and memories, please bear that in mind when ordering.  Please note, as standard I do not return any left over clothing but am happy to at the buyers expense.

Use of photos

We take photos of your finished bear an may use it in future advertising, promotions and our Facebook, website an Instagram page. Please let us know if youd like your bear to remain anonymous or youd like any details (ie dates, names etc) blanked out

Privacy Policy

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Facebook.com or Ebay.co.uk or its related sites and services.

This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Facebok or Etsy or any third party services you access through Facebook or Ebay. You can reference the Facebook or EbayPrivacy Policy to learn more about its privacy practices.

Information I Collect

To fulfil your order, you must provide me with certain information (which you authorized Facebook or Ebay to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information if you contact me directly.

Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

  • as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;

  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;

  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and

  • as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Facebook and EbaySeller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Facebook and EbaySeller Policy and Terms of Use.

Information Sharing and Disclosure

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

  • Facebook and Ebay. I share information with Facebook and Ebay as necessary to provide you my services and comply with my obligations under both the Facebook and Ebay Seller Policy and Facebook and Ebays Terms of Use.

  • Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies and payment platforms (ie. Paypal) I will share your personal information with these third parties, but only to the extent necessary to perform these services.

  • Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.

  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period of 5 years to comply with HMRC regulations, after which time data will be shredded or incinerated. All my data is held on a business computer operated only by me (Michelle Campbell) and which has two step identification authorisation to use. All of your data is held on a spreadsheet for a period of 5 years, again this can only be accessed by me and will only ever be used for third party for tax and legal purposes.

Transfers of Personal Information Outside the EU

I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

  • Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

  • Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.

  • Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

  • Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
